I. General

The website www.net-net.hr and gravelight.eu are owned by the company NET d.o.o., Čakovec, Šenkovec, Jelenska 7, OIB: 04816502912

All materials contained on www.net-net.hr and the gravelight.eu website are the exclusive intellectual property of NET d.o.o., may be used solely with the express permission of the copyright holder and the trademark and / or design rights holder. NET d.o.o. allows the use of the services and content of the www.net-net.hr and gravelight.eu website as governed by these Terms of Purchase.

These Terms of Purchase are part of the Seller’s obligation in accordance with the provisions of the Consumer Protection Act and are intended to inform the Buyer in a clear and understandable manner before concluding the distance contract about a number of circumstances relevant to the conclusion, performance, termination of the contract, all in accordance with the legislation.

The term Buyer, also refers to: the classic consumer: a natural person who, outside of any activity, orders and pays for any product through the services of a web store present on the Seller’s website, but also buyers of craftsmen, sole traders and natural persons engaged in business activities, and who are protected by the provisions of the Consumer Protection Act only if they purchase products irrespective of their business activities, and to all other customers such as legal entities.

Seller acts on his own behalf by selling through the website www.net-net.hr and gravelight.eu.

The purchase terms form part of the distance contract along with the specifications and price (s) of the product (s) purchased, and before confirming the purchase order for a particular product, the Buyer will be required to accept / declare that it is familiar with them, while after confirmation orders (contracting) shall be delivered to the Buyer as the contents of an e-mail confirming that the contract has been concluded. Seller reserves the right to change the terms at any time, provided that these changes take effect upon posting on these sites.

When the Buyer confirms and executes the order, the contract has been concluded, and the Seller will immediately notify by e-mail that the contract has been concluded.

A properly concluded contract requires the Buyer to be a person with full legal capacity.

The buyer is responsible for the completeness and truthfulness of the information entered during registration.

The purchase terms are divided into the categories / information below.

Access to the www.net-net.hr and gravelight.eu websites may sometimes be inaccessible due to the works, maintenance or introduction of new content and in cases of unforeseen circumstances beyond the control of the Seller, which the Seller will endeavor to eliminate as soon as possible.

II. The main features of the goods

The main features of the goods: the products are shown descriptively and in photographs, and the information about them is based on the seller’s database.

Product photographs are for illustrative purposes only and do not necessarily correspond to the products being ordered. The seller especially emphasizes that the visual identity of the product shown in the photo does not have to match the appearance of the product in reality, especially considering the monitor settings on the buyer’s computer, differences in color perception as the buyer sees them on the screen, etc. In the case of the above discrepancy between the product shown in the photo and the product delivered is not a product shortage.

In the case of obvious errors or defects in the product data displayed on www.net-net.hr and gravelight.eu, the Seller reserves the right to terminate the contract unilaterally.

Only products that are indicated to be available and available in the order may be subject to the order. Due to the large number of orders placed at the same time on www.net-net.hr and gravelight.eu, it may be that the information on the availability of products is not identical with the situation in the Seller’s warehouse.

If the ordered product is not available in stock, the Seller will inform the Buyer that the product is currently unavailable, the period within which the product is available, and at the same time offer the possibility of buying an alternative product from www.net-net.hr and gravelight.eu which is available for delivery and which by its characteristics is the closest to a non-deliverable product.

III. Product price

The prices displayed on the website www.net-net.hr and gravelight.eu are expressed in HRK. The cost of VAT is included in the price of the product. Shipping costs, customs clearance for non-EU shipments, additional shipping costs to islands within the EU are not included in the product prices and are therefore separately paid.

Before confirming the order, the price of the product, the delivery price if it is collected, the price of VAT and the final price are separately stated so that the Buyer can see the final price he pays for the ordered purchase service.

In the case of payment by e-banking and wire transfer, payment and / or interbank transaction costs are not included in the price.

IV. Shipping costs

They are communicated when ordering for each product, and the total shipping costs in case of ordering more than one product.

The shipping price is divided into two classes into two groups: delivery within Croatia, delivery abroad – including delivery within the EU.

Note: The stated shipping rates and benefits related to the same apply only to shipments in Croatia.

The packages are carefully packed and the delivery is trying to fulfill all expectations. However, deliveries to larger cities within Croatia can be waited for 1 to 3 business days, while deliveries to smaller towns in Croatia take 5 to 8 business days, and delivery to the islands is according to the carrier’s schedule. * We do not deliver any goods on Sundays and public holidays.

In the event of failure to deliver the goods correctly to the address of the Buyer indicated by the Buyer, the Buyer shall bear the costs of re-delivery to the same or another address, depending on what information the Buyer will provide to the Seller when verifying the delivery of the order.

Delivery to Slovenia

The ordered products are shipped to the entire territory of Slovenia. Delivery is via DPD Croatia.

V. Costs of using remote communications

The seller does not incur any additional costs for the means of remote communication.

VI. Payment terms and conditions, delivery terms, delivery time

Products are ordered by selecting, using the menu and filling out an electronic form. The buyer can order and purchase the product as a registered or unregistered user. A product is considered to be ordered when the customer goes through the entire ordering process.

For security reasons, we currently only accept card payments (debit and credit cards).

Credit Cards (Maestro, MasterCard, Visa, Premium Visa, Diners, Discover)

In case of payment by credit card, general payment and e-banking, payment must be made no later than the deadline indicated in the e-mail message confirming that the contract has been concluded.

With respect to credit card payment, the Seller points out that the card payment system is integrated on the pages. After selecting a “Card” payment, the fields for entering card information will open. Card and owner information is not stored on the seller’s servers. Diners and Premium Visa cards can also be paid in installments. It is necessary to choose the number of installments, from two to six. Costs will be calculated according to the customer’s choice and the card will be debited successively every month according to the number of installments selected. The purchase was made after successful card authorization. If your system refuses to authorize your card payment, you’ll need to choose one of the alternative payment methods. The seller has no information about the causes of card refusals, they may be of a technical or business nature.

If the buyer does not receive notification that the contract has been concluded after the ordering process is completed, it is suggested to check:

· Is the message in the Junk / Spam folder

· The mailbox is full

In case the payment is not made within the specified deadline, the Seller will act upon the payment subsequently made out of time by delivering the purchased products, and if he cannot make the delivery for justified reasons, the contract will unilaterally terminate and refund the payment.

If payment is properly made and visible in the Seller’s account, the Seller will proceed to deliver the ordered products. The order invoice is shipped with the shipment along with the goods.

The ordered products are shipped to the whole territory of the Republic of Croatia, the EU and beyond. Delivery is via Overseas and DPD Croatia.

Delivery will take place no later than 15 business days from the visible payment on the Seller’s account. If it becomes impossible to deliver the selected product because the product is no longer available, the Seller is obliged to notify the Buyer immediately, and the Buyer has the right to terminate the contract and request a refund or agree to a subsequent delivery deadline. All items ordered will be shipped in one package. If this is not possible due to stock status, the Seller reserves the right to deliver in multiple shipments.

Delivery is made in accordance with the terms of use of the delivery service, and is considered to have been made at the time of delivery of the product to the delivery service.

All orders received on weekdays up to 12 hours are processed on the same day so that in most cases the goods ordered will be delivered to the delivery service on the same day. Orders after 12 o’clock on weekdays (except Fridays) will be delivered the next day, while orders from Friday after 12 o’clock will be delivered on Mondays. Mondays also process orders received during Saturdays and Sundays. After the goods are delivered to the delivery service, a shipment number will be sent to the Buyer’s email address so that their status can be checked at shipping service address

Unfortunately, the Seller is not able to influence the further delivery speed and possible complications related to the delivery itself incurred by the delivery service. For each shipment, the Buyer certifies and signs the delivery note upon receipt of the shipment.

To the islands covered by Overseas the goods will be shipped according to the schedule in the table, and to all other islands not covered by Overseas the Seller sends the goods via HP.

–  Parcels must be submitted for delivery two business days before the date of mentioned delivery to the island not connected by bridge.
– * Lastovo, Šolta and Dugi Otok packages are delivered twice a month, every first and third Saturday of the month, depending on the quantity of packages.

– DPD Croatia d.o.o. reserves the right to change the “Delivery Schedule to Islands and Small Towns” without notice in case of technical difficulties or force majeure.

The goods are delivered by Overseas courier service or DPD Croatia.

NOTE: The stated delivery days are subject to change, please contact customer service info phone on 00385 40 343 233 or 00385 40 314683, 7 am -15 pm for accurate shipping information on islands and smaller places.

If the product sent to the Buyer returns because the delivery service failed to deliver, the Buyer will be notified by email and offered the following options:

· To resend the ordered product by e-mail at the request of the Buyer to the address of the Buyer or consignee

· To pick up the ordered product at the address of the Seller with the previous telephone agreement on the term of the delivery

If the Customer does not reply to the e-mail sent to him within 3 days and selects one of the offered options, the selected product will be delivered to the customer’s address by delivery service.

When the Seller delivers the product via the delivery service to the Buyer, the Buyer is obliged to take over the signature on the invoice, confirming that the product has been duly delivered.

In case the Buyer orders the goods and refuses to receive them, the Seller has the right to deduct from the paid purchase price the amount of the shipping costs and other handling costs from the shipping price list.

Delivery times do not include:

·The day of receipt of the order / request

· Delay time due to incorrect and incomplete Customer address

· Delay time due to force majeure or other reasons for which the Seller is not accountable

· Non-working days if they represent the beginning or the end of the deadline

Ordered products cannot be paid for on delivery.

Ordering is possible via the web, and can be picked up in person at a wholesale warehouse within the NET d.o.o. factory. Čakovec, Zrinsko – Frankopanska 17, weekdays, 7 am -15 pm.

VII. Unilateral termination of contract

Only the Buyer who has concluded the Distance Contract as described above is entitled, without giving reasons, to unilaterally terminate the contract within 14 days. The 14-day period begins on the day on which the Goods or the third party designated by the Buyer, other than the carrier / delivery person, are delivered,forming the subject of the contract. If the Buyer has ordered multiple pieces of goods to be delivered separately by one order, or in the case of goods that are delivered in several pieces or more shipments, the period begins to run from the day the last piece or the last shipment of goods is handed over.

If the Seller does not notify the Buyer of this right, the Buyer’s right to unilaterally terminate the contract shall terminate within 12 months of the expiry of the termination period (the 12-month period shall begin to expire after the expiry of the 14-day period provided for regular termination in the event of duly notified). If, however, the notice of the right to unilateral termination is delivered within 12 months, the right to unilateral termination is terminated upon expiration of 14 days from the date of receipt by the Buyer.

The Buyer is obliged to inform the Seller of its decision to terminate the contract before the expiry of the unilateral termination period by Notice of unilateral termination of contract which can be filled in electronically and sent to: otprema@net-net.hr. The Seller shall confirm the receipt of the notice of unilateral termination of the contract by electronic mail without delay or as soon as possible.

If you unilaterally terminate this Agreement, we will refund the money we received from you, minus delivery costs, without delay, and no later than 14 days after we received your decision to unilaterally terminate the Agreement. The Buyer shall bear the cost of returning the goods. The refund will be made in the same way that you made the payment. We can only refund you after the goods have been returned to our address.

You are obliged to return the goods to us immediately and no later than 14 days after you have sent us your decision on unilateral termination. Return the goods by mail in a demonstrable manner to NET d.o.o. Čakovec, Zrinsko – Frankopanska 17.

It is considered that you have fulfilled your obligation to deliver the goods personally to us at our warehouse before the expiry of the above deadline. You are responsible for any impairment of goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics and functionality of the goods. If the product is returned defective, with major damages or without parts and documentation, and if they are not delivered within 8 days, the Buyer is deemed not to have fulfilled its obligation to return the goods, and the Seller is not obliged to make a refund.

Buyer is not entitled to unilateral termination of the contract if:

· The Service Agreement has been fully fulfilled by the Seller and the fulfillment has commenced with the express prior consent of the Buyer and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the contract from this section if the service is fully fulfilled;

· The subject matter of a contract for goods or services the price of which depends on changes in the financial market that are outside the influence of the Seller and which may occur during the term of the Buyer’s right to unilaterally terminate the contract;

· The object of the contract are goods that are made to the specification of the Buyer or that are clearly tailored for the Buyer;

· Subject to contract is perishable goods or expired goods;

· The object of the contract are sealed goods which, for health or hygiene reasons, are not fit for return, if they were sealed after delivery;

· The object of the contract are goods which by their nature are inherently mixed with other things after delivery;

· The subject matter of the contract is the delivery of alcoholic beverages whose price is agreed upon at the time of the conclusion of the contract, and delivery may only take place after 30 days if the price depends on changes in the market which are beyond the influence of the trader;

· The Buyer specifically requested the visit of the Seller for emergency repairs or maintenance work, provided that during such a visit, in addition to those services specifically requested by the Buyer, the Seller provides other services or supplies other than necessary goods carrying out emergency repairs or maintenance work, the Seller has the right to unilaterally terminate the contract in connection with these additional services or goods;

· The subject matter of the contract is the delivery of sealed audio recordings or videos, or computer programs, which have been sealed after delivery;

· The object of the contract is the supply of newspapers, periodicals or magazines, with the exception of subscription contracts for such publications;

· Contract concluded at public auction;

· The object of the contract is the provision of non-residential accommodation, the provision of goods transportation services, vehicle rental services, food and beverage delivery services or leisure services, if it is agreed to provide the service on a specific date or for a specified period;

· The subject matter of the contract is the delivery of digital content not delivered on a physical medium if the fulfillment of the contract started with the express prior consent of the Buyer and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the contract;

VIII. Liability for material defects / Complaint

The seller is responsible for the material defects of the things he sells on his site in accordance with the positive regulations of the Republic of Croatia, in particular the Law on Obligations.

The products ordered are packaged in such a way that they are not damaged by the usual handling / shipping manipulation.

In case the shipment is damaged during transport, such damage is visible when picking up the shipment, in which case we suggest that the shipment is not picked up by the Buyer. We ask Customers to contact us so that we can check the shipment status and send a new one as soon as possible.

Upon receipt of the goods, the checking of the order depends on the buyer, and the buyer is obliged to compare the received items with the invoice;

In the event of a noticeable defect of the product when picking up the shipment, the Buyer is not obliged to pick up the shipped product; It is considered that the products duly received by the Buyer did not have a noticeable defect. The buyer is entitled to a complaint in respect of material defects in the deadlines and for the reasons prescribed by the provisions of the Law on Obligatory Deadlines. In order to determine as quickly as possible the specific order to which the Buyer objects, the Buyer is asked to indicate the order number, account number or his username.

The buyer is entitled to a justified complaint and to return the goods in the following cases:

· Delivery of goods not ordered

· Delivery of goods that have expired

· Delivery of defective goods or damage that did not occur during transportation

If the product has a hidden defect (the defect that could not be detected by normal inspection when picking things up) that the Buyer determines upon opening the product – the Buyer has the right to unilaterally terminate the contract and refund, replace the product, remove the defect or reduce the price.

The seller will otherwise consider the claim valid if the product review determines that it meets the requirements for a claim under the Obligations Act and the Consumer Protection Act. In this case, within 15 days of receipt of a valid complaint, they will replace the product or return the full amount paid upon termination of the contract. If, however, it finds that the complaint is not valid, ie if it rejects the complaint, it will notify the Buyer within 15 days from the day of receiving the complaint.

The Seller will accept the return of damaged, defective or incorrectly delivered goods at his own expense, if the complaint is found to be justified and the Buyer has not affected the correctness, damage or any defect of the goods.

In case of justified complaint, the cost of replacement with a new product shall be borne entirely by the Seller.

In the event that the Buyer decides to replace the correct product, the Seller will make a replacement if the product is undamaged, unused, or otherwise impaired. In this case, the Buyer bears the cost of returning and resending the goods.

Using product descriptions and information:

Therefore, before using our products, be sure to read the label on the product and follow all the instructions given for safe use of the product. IX. Duration of the contract

The contract entered into by the Buyer with the Seller is a one-off contract for the purchase of distance products consumed by the delivery of goods and payment made by the buyer in the event that it is not terminated. These Terms of Purchase are an integral part of the agreement.

In our business, we collect and process the personal information of our customers and parties interested in our products, while respecting all relevant laws and regulations.

NET d.o.o. does not collect information about children. If we believe that such information has been transmitted to us without the consent of the parents or guardian of children under the age of 16, we will remove it without delay. Minors under the age of 16 may not use the website www.net-net.hr i gravlight.eu. No part of the website www.net-net.hr i gravlight.eu it is not designed to appeal to anyone under the age of 16.

What is the legal basis for processing personal data?

The Customer enters into a contractual relationship, which is the basis for the purchase of products and services of the customer’s choice on the Website by entering his / her personal data and confirming (clicking) on the acceptance of the General Terms and Conditions and this Privacy Policy and conditions of use of personal data. www.net-net.hr i gravlight.eu, which is contained in the Terms of Purchase (pre-contractual notices) and therefore the processing of this personal information is lawful because actions are taken at the request of the Buyer to realize the purchase of products and services to the Purchaser’s request.

With which recipients does NET d.o.o. share personal information?

NET d.o.o. will not share the personal information of the Customer or the Customer with other parties except in the cases specified in the following point and in situations where positive regulations so require.

NET d.o.o. will, when required by the implementation of a contract to purchase products or services to the Customer’s request, share the Customer’s personal information with:

1. Providers of services of distribution of goods with which he has a permanent contract and for this purpose for fulfilling orders, delivering packages, sending land mail and e-mail. The Distribution Service Provider may request the Buyer to view his identity card at the time of delivery of the package when personally picking up the goods, all for the purpose of realization of the package delivery service and records of who has received the package. If the Buyer refuses to provide this information, the package will not be served.
2. In the process of submitting prizes to the sponsors of the prize contests, NET, who is the organizer of the prize contest in the rules of the prize contest, indicates that the delivery of the prize to the winner will be organized by the sponsor.

The customer activates the process of card processing and payment by confirming (clicking on) the “pay” link.

NET d.o.o. does not at any time dispose of, collect or process personal information entered for the purpose of card processing and payment. Customers are advised to be informed of the processing of personal information by Corvus INFO d.o.o. on the website where the payment process takes place. Personal information stored with Corvus INFO d.o.o. is deleted immediately after the card processing and billing process is completed except with the Buy Now option.

The Buy Now option is an option in which the Buyer gives special consent by clicking on the specially marked “Remember My Data” box, which agrees to activate this option, which allows him not to enter his data every time he buys, but with his consent the Corvus system does INFO d.o.o.
